1. Introduction

We at The Waterfront Hotel take your privacy seriously.

This privacy notice applies to the careers mini-site within The Waterfront Hotel’s website at https://careers.waterfronthotelmalta.com/ and also to other official presence on any social media (e.g. Facebook and LinkedIn). Where we refer to the “Website”, we also refer to data collection via these third-party platforms.  This Notice covers the collection, processing and other use of personal data under the General Data Protection Regulations (“GDPR”).

For the purpose of the GDPR we are the data controller and any enquiry regarding the collection or processing of your data should be addressed to the General Manager at our address, “The Waterfront Hotel”, Triq ix-Xatt, Gzira, Malta, or by sending an email to  [email protected] . By using the Website, you confirm you are aware of this Notice.

2. Information we collect

We will collect personal data on this Website when it is directly provided to us by you, e.g.:

  • your name, surname, e-mail address, telephone number and your Curriculum Vitae, if you are applying for a job;
  • your name and e-mail address if you are sending us an enquiry through our “contact us” online form.
  • Other documents, qualifications and professional references that we may need in order to proceed with your application.

We may also use analytical and statistical tools that monitor details of your visits to our website and the resources that you access, including, but not limited to, traffic data, location data, weblogs and other communication data (but this data will not identify you personally using only our resources).

If we look through professional networking and social media sites to identify people that have skills and talents we would like to have at The Waterfront Hotel, we will only look at information that is publicly available.

2.1 Cookies and Widgets

We may use third-party service providers to serve ads and/or collect certain anonymous information when you visit our Web site. You may learn more about cookies at http://www.allaboutcookies.org .

Our website also features social media widgets, such as the Facebook “like” and “share” buttons, Twitter “follow” button, amongst others. These social media features are either hosted by a third party or directly on our website. Your interaction with these widgets is governed by the privacy policy of the respective websites.

3. Security

The transmission of information via the Internet or email is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of data while you are transmitting it to our site; any such transmission is at your own risk. Once we have received your personal data, we will use adequate procedures and security features to try to prevent unauthorised access.

4. Where we store your data

Data that you provide to us in a contractual relationship is held and processed by “The Waterfront Hotel” and may be shared internally between the companies of the “Mizzi Organisation”, of which the company forms part of, in relation to the processing activities indicated above.

As part of the services offered to you, for example through our Website, the information you provide to us may be transferred to and/or stored in European based “Cloud Servers”. We use remote website server hosts to provide the website and some aspects of our service may require that this data is processed across multiple countries within the European Union – this is generally the nature of data stored in “the Cloud”. It may also be processed by staff operating our servers who work for one of our suppliers, e.g. our website server host.  We use appropriate third-party contractual safeguards and controls in order to protect and safeguard the personal data that you send to us.

5. Use of your information

We may hold and process personal data that you provide to us, or that we identify through public sources in accordance with the GDPR.

The information that we collect and process relating to you is used to process your job application and to meet our contractual commitments to you.

In addition, we may use the information for the following purposes:

  • To respond to your enquiries; and
  • To inform you about any changes to our website, such as new positions advertised, improvements or service changes within the website.

6. Disclosure of your information

The information you provide us when applying for a vacancy will be reviewed by the Company’s Human Resources Department and any other Department or personnel within the Company who is required to be involved in the hiring process.

When sending an enquiry, the data you provide us will be processed by our in-house Customer Service. Occasionally we may receive a request to disclose information about you with law enforcement, regulators and supervisory authorities where we are legally required to do so. We will always ensure that the organisation requesting the information has a legal basis to do so and will only share the minimum amount of information required in a secure way.

Where you have provided us with references from previous employers, we may contact them in order to understand more about your background. We will inform you before contacting them.

We may also have to disclose your personal data outside of our group:    

(a) if we sell or buy any business or assets, in which case we may disclose your personal data to the prospective seller or buyer of such business or assets;

(b) if The Waterfront Hotel’s business is bought by a third party, in which case personal data held about the Hotel’s employees may be transferred to the buyer. However, any such transfer will only be on terms that the confidentiality of your personal data is protected and that the terms of this privacy notice will continue to be complied with by the recipient. If this happens, you will be notified of such transfer; and

(c) otherwise, we will process, disclose or share your personal data only if required to do so by law or in good faith and the belief that such action is necessary to comply with legal requirements or legal process served on us or the website or to be able to service a contract of employment.

7. Data Retention

If you have applied for a vacancy, we will keep your details, including your CV, for a period of six (6) months for consideration should a related vacancy arise within our Group companies. We will delete your personal data, where applicable, except when we need to comply with a legal obligation.

If you have been selected as a preferred candidate for employment, your personal data would be processed in line with the Data Processing Agreement that would be presented to you prior to employment.

8. Your rights

As a data subject, you have the right to:

  • be informed about our personal data collection and processing activities;
  • access, at any time, the information you have provided us;
  • rectify personal data that we hold about you where you believe it is inaccurate;
  • restrict processing of your personal data;
  • object to our processing of your personal data;
  • request erasure of your data, where applicable; and
  • request a transfer to another Controller, where applicable.

Please note that in terms of the applicable laws, your rights in relation to your personal data are not absolute.

Nonetheless, you may exercise the rights indicated in this section by contacting us or our Data Protection Officer at the details indicated above.

If you disagree with our processing of your personal data, or you feel your rights are not being respected, you have a legal right to lodge a complaint with a supervisory authority responsible for data protection.
